This Privacy Policy explains how Mr Bargain (ABN 12 671 397 587) ("Mr Bargain", "we", "us" or "our") collects, uses, discloses and protects your personal information when you visit mrbargain.com.au (the "Site"), shop with us online or in store, buy from us through an online marketplace, or otherwise contact us (together, the "Services").

We are committed to handling personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using our Services, you acknowledge that your personal information will be handled as described in this policy.

1. What personal information we collect

The information we collect depends on how you interact with us. It may include:

  • Contact details – your name, email address, phone number, and billing and delivery addresses.
  • Order information – the products you buy, order history, payment confirmation (we do not store your full card details), returns and warranty claims.
  • Account information – your login details and preferences if you create an account.
  • Customer support information – anything you tell us when you email, call, message or visit us.
  • Device and usage information – your IP address, browser and device type, pages viewed, products viewed or added to cart, and how you arrived at our Site, collected using cookies, pixels and similar technologies.
  • Marketing preferences – whether you have agreed to receive marketing from us.

We collect most information directly from you. We may also receive information from service providers who help us run our business (such as Shopify and our payment processors), and from online marketplaces when you buy one of our products through them.

You can choose not to provide some information, but we may then be unable to process your order or provide certain Services. Where practical, you may browse our Site without identifying yourself.

2. How we use your personal information

We use your personal information to:

  • process and deliver your orders, payments, returns, refunds and warranty claims;
  • create and manage your account;
  • respond to your enquiries and provide customer support;
  • send you order, delivery and service messages;
  • send you marketing (by email or SMS) where you have agreed to receive it;
  • show you relevant advertising on other websites and apps (see section 4);
  • understand how our Site is used so we can improve it;
  • detect and prevent fraud and misuse; and
  • comply with our legal obligations.

3. Who we disclose your personal information to

We do not sell your personal information. We disclose it only as needed for the purposes above, including to:

  • Our e-commerce and IT providers, such as Shopify (our online store platform) and our point-of-sale and inventory systems;
  • Payment processors, who handle your card and payment details securely;
  • Delivery and logistics providers, so we can ship your order;
  • Online marketplaces we sell through, where you buy one of our products on that marketplace;
  • Analytics and advertising partners, such as Google, Meta (Facebook and Instagram) and TikTok (see section 4);
  • Professional advisers, such as accountants and lawyers; and
  • Government and law enforcement agencies, where required or authorised by law.

4. Advertising, analytics and customer lists

We use cookies, pixels and similar tools from Google (including Google Analytics and Google Ads), Meta and TikTok to measure how our Site and advertising perform and to show you ads for our products on other websites and apps, including Google Search, Google Shopping, YouTube, Gmail, Facebook, Instagram and TikTok.

Customer lists (Google Customer Match and similar tools). If you have agreed to receive marketing from us, we may share your email address and/or phone number with advertising partners such as Google so they can show you relevant ads from Mr Bargain, or so we can avoid showing you ads for products you have already bought. This information is hashed (converted into an unreadable code) before it is uploaded. The partner matches it against its own users and does not use it for any other advertiser. Google's use of this information is governed by Google's policies, available at policies.google.com/privacy.

You can opt out at any time by:

  • unsubscribing from our marketing emails or SMS (this also removes you from customer lists we share);
  • contacting us using the details below;
  • adjusting your ad settings at adssettings.google.com and in your Facebook, Instagram or TikTok account settings; or
  • blocking or deleting cookies in your browser.

5. Cookies

Cookies are small files stored on your device. We use them to keep our Site working (for example, your cart), remember your preferences, understand how visitors use our Site, and support advertising. For information about the cookies Shopify uses, see shopify.com/legal/cookies. You can set your browser to refuse cookies, but parts of our Site may not work properly if you do.

6. Direct marketing

We will only send you marketing emails or SMS messages if you have agreed to receive them, in line with the Spam Act 2003 (Cth). Every marketing message includes a way to unsubscribe. Even if you unsubscribe, we may still send you messages about your orders, warranty or account.

7. Overseas disclosure

Some of our service providers, including Shopify, Google, Meta and TikTok, store or process information outside Australia, including in the United States, Canada, Ireland and other countries. We take reasonable steps to ensure these providers handle your information in a way that is consistent with the Australian Privacy Principles.

8. Security and retention

We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Payments are processed through secure, encrypted payment providers, and we do not store full card numbers. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

We keep personal information only for as long as we need it for the purposes in this policy, including to meet warranty, tax and other legal record-keeping obligations. After that, we securely delete or de-identify it.

9. Accessing and correcting your information

You can ask to access the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date or incomplete. You can also ask us to delete your information, subject to our legal obligations. Contact us using the details below. We may need to verify your identity first, and we will respond within a reasonable time (usually within 30 days). We will not charge you for making a request.

10. Children

Our Services are not directed at children, and we do not knowingly collect personal information from children under 16 without a parent or guardian's consent. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. Complaints

If you have a concern about how we have handled your personal information, please contact us first using the details below. We will investigate and respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.

12. Changes to this policy

We may update this policy from time to time. The latest version will always be available on our Site, with the "Last updated" date shown at the top.
